1. Agreement to Terms

By accessing or using the Stratus Aeronautical website (stratusaero.io), placing a pre-order, or signing up to our mailing list, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our site or place an order.

These Terms constitute a legally binding agreement between you and Stratus Aeronautical ("Stratus," "we," "us," or "our").

2. Eligibility

To place a pre-order or use our services, you must:

• Be at least 18 years of age. By placing a pre-order, you confirm that you are 18 or older.
• Be a resident of the United States or Canada.
• Have the legal capacity to enter into a binding contract.

Geographic restriction: Our products and services are offered exclusively to residents of the United States and Canada. We do not offer goods or services to residents of the European Union, the European Economic Area (EEA), the United Kingdom, or any other jurisdiction not listed above. If you are located in one of those regions, please do not place an order.

3. Pre-Order Terms

Stratus sells products on a pre-order basis. Pre-orders are reservations for products that are currently in development and are not yet in stock or ready to ship. By placing a pre-order, you acknowledge and agree to all of the following:

• Not an in-stock purchase. Pre-orders are not purchases of immediately available goods. You are reserving a unit from a future production run.
• Estimated pricing. Prices displayed at the time of pre-order are estimates in USD. The final price will be determined and confirmed prior to shipment. If the final price differs from the estimated price, we will notify you by email before any charge is made and give you the option to cancel your pre-order for a full refund.
• Timelines are estimates. Any delivery windows or production timelines provided are good-faith estimates only and are not guarantees. Development and manufacturing delays can and do occur.
• Fulfillment triggers. Orders will be fulfilled based on production milestones, not fixed calendar dates. We will communicate progress updates via email.
• Right to cancel production. Stratus reserves the right to cancel a product or production run at any time. In the event of a production cancellation, all affected pre-order customers will receive a full refund to their original payment method.

4. Payment Terms

• Processor. All payments are processed by Stripe, Inc., a third-party payment processor. Your payment information is transmitted directly to Stripe and is subject to Stripe's Privacy Policy and Terms of Service. Stratus does not store your full card details.
• Charge timing. Your payment method will be charged at the time you place your pre-order, not at the time of shipment.
• Currency. All prices are listed and charged in US Dollars (USD).
• Stripe errors. Stratus is not responsible for payment processing errors, declined charges, or other issues arising from Stripe's platform. For processing disputes, please contact Stripe directly.
• Sales tax. Stratus is not currently collecting sales tax on pre-orders. This may change as our business grows and tax obligations are assessed. Any changes to our tax collection practices will be disclosed prior to checkout.

5. Cancellation & Refund Policy

Before shipment:

• You may cancel your pre-order and receive a full refund at any time prior to receiving a shipment notification from us.
• To cancel, contact us at hello@stratusaero.io with your order details. We will confirm cancellation and process your refund within 5–10 business days to your original payment method.

After shipment (returns):

• You have 14 days from the date of delivery to request a return.
• Items must be unopened and in their original, unused condition to be eligible for a return.
• To initiate a return, email us at hello@stratusaero.io within the 14-day window. We will respond with return instructions within 3 business days.
• Refunds will be issued to your original payment method within 5–10 business days of us receiving and inspecting the returned item.
• Return shipping costs are the responsibility of the customer, unless the return is due to a defect or error on our part.

6. Shipping Policy

• Shipping destination. We ship only to addresses within the United States and Canada.
• Shipping costs. Shipping costs are not included in your pre-order price. Shipping charges will be calculated and billed separately at the time of shipment, and you will be notified of the amount before your card is charged.
• Carrier delays. Once a shipment has been handed off to the carrier, Stratus is not responsible for transit delays, lost packages, or carrier errors. Risk of loss passes to you upon handoff to the carrier.
• Delivery estimates. Any estimated delivery windows are provided by the carrier and are not guaranteed by Stratus.

7. Product Descriptions & Accuracy

• All product specifications, renders, images, and descriptions on this site reflect our current development state and are subject to change as the product evolves before final production.
• Images may show pre-production units, prototypes, or 3D renderings that do not represent the final manufactured product.
• Where indicated, placeholder images labeled "RENDER COMING SOON" or similar are non-final visual representations only and carry no warranty as to the appearance or specifications of the final product.
• We will make reasonable efforts to communicate significant design changes to pre-order customers prior to production.

8. Intellectual Property

All content on this site — including but not limited to text, product images, renders, logos, branding, and design — is the exclusive property of Stratus Aeronautical and is protected by applicable copyright, trademark, and other intellectual property laws.

You may not:

• Reproduce, copy, or redistribute any content from this site without our prior written permission.
• Use Stratus Aeronautical's name, logo, or branding for any commercial purpose.
• Reverse-engineer or attempt to copy any product design depicted on this site.

9. Beta Access & Confidentiality

This website is currently operating in a gated beta phase. Access is provided on a limited, invite-only basis. By accessing the site during this beta period, you agree to:

• Keep your access credentials confidential. Do not share your beta access link, login credentials, or invite code with third parties.
• Treat beta content as confidential. Product details, pricing, renders, and other site content during the beta phase are not intended for public distribution. Do not post, share, or publish site content publicly without our written permission.
• Stratus reserves the right to revoke beta access at any time, with or without notice, at our sole discretion.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Stratus Aeronautical, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of — or inability to use — this website, our products, or our services, even if we have been advised of the possibility of such damages.

In no event shall Stratus Aeronautical's total liability to you for all claims arising out of or relating to these Terms or your use of our products or services exceed the total amount you paid to Stratus Aeronautical in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.

11. Disclaimer of Warranties

This website and all content on it are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the site will be uninterrupted, error-free, or free of viruses or other harmful components. Product specifications and availability are subject to change without notice during the pre-order and development phase.

Any limited product warranty, if offered, will be stated explicitly in product documentation at the time of shipment.

12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of our products or services shall be subject to the exclusive jurisdiction of the state and federal courts located in Oldham County, Kentucky. You consent to personal jurisdiction in those courts.

13. Privacy Policy

Your use of this site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand how we collect, use, and protect your information.

14. Acceptable Use

You agree not to:

• Use the site for any unlawful purpose.
• Attempt to gain unauthorized access to our systems or infrastructure.
• Submit false or misleading information during checkout or communications with us.
• Interfere with or disrupt the operation of the site.
• Use automated tools to scrape, crawl, or harvest content from the site.

15. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we do, the "Last updated" date at the top of this page will be revised. For material changes, we will notify existing customers by email at the address on file.

Your continued use of the site or your maintenance of a pre-order after changes are posted constitutes your acceptance of the updated Terms.
